IWPA Terms and Conditions

1. About these Terms
These Terms and Conditions (the Terms) govern access to and use of the IWPA website, assessment, profiles, downloads, participant invitations, and related services.
The IWPA platform is operated by The Fourth Dimension Training & Consultancy FZ LLC, with an address at Meydan Grandstand, 6th Floor, Dubai, United Arab Emirates (4D, we, us, or our).
IWPA, including its assessment methodology, item framework, psychometric structure, associated content, and related intellectual property, is jointly owned by The Fourth Dimension Training & Consultancy FZ LLC and PCI Learning & Development.
The technology used to administer the assessment, calculate scores, and generate profiles is provided through Phoenix by 4D.
Where services are supplied through another affiliated or local contracting entity, that entity will be identified at checkout, in an order form, or in a regional supplement.
By purchasing, accepting an invitation to, or taking an IWPA assessment, you agree to these Terms and acknowledge the Privacy Policy and Assessment Consent.
2. What IWPA provides
IWPA is a structured psychometric assessment designed to describe work-related tendencies across multiple areas, including work personality, emotional intelligence, applied cognitive approach, occupational interests, and response quality.
The assessment contains 120 items across multiple response formats and normally takes approximately 60 minutes to complete.
Depending on the product purchased or the campaign through which you were invited, IWPA may provide an Individual Classic Profile, Career Guide Profile, organizational profile, participant summary, comparison output, or another approved profile format.
3. Assessment results and limitations
IWPA describes tendencies and patterns. It does not define a fixed identity and does not provide a complete account of a person.
IWPA is not a clinical or medical diagnostic tool. It does not diagnose a psychological, psychiatric, neurological, or medical condition and is not a substitute for advice from a suitably qualified professional.
There is no overall pass or fail result. No score represents a person's overall intelligence, employability, performance, suitability, or human worth.
Results should be considered alongside other relevant information. IWPA should not be used as the sole basis for a hiring, promotion, dismissal, admission, licensing, medical, financial, or other consequential decision.
4. Deterministic scoring and AI-supported interpretation
Assessment responses are scored using fixed, versioned, deterministic rules. The same response set produces the same scores under the same assessment and scoring version.
We may use external artificial intelligence service providers to help generate written explanations, summaries, and recommendations from already-calculated results. AI does not calculate or alter assessment scores and does not make employment or other consequential decisions.
A profile may contain recommendations or suggested career directions. These are interpretive guidance, not guarantees of suitability, employment, licensing, admission, income, or success.
5. Eligibility and age
You must be at least 18 years old to purchase or take IWPA independently.
Use by a person under 18 requires a separately approved institutional or guardian-consent process. The standard public assessment flow is not intended for independent use by children.
You must provide accurate information and must have legal authority to enter into these Terms.
6. Checkout and payment
Prices, currencies, taxes, and included services are shown at checkout or in the applicable order form.
You are responsible for providing a correct name and email address. Assessment access and profile notifications may be sent to the email address supplied at checkout or by the inviting organization.
Where checkout is offered without payment, no payment is collected. Where a paid checkout is enabled, payment is handled through the payment method and provider shown at checkout.
Unless required otherwise by applicable law:
- a purchase may be cancelled before its assessment token is used;
- once the assessment has begun, the purchase is normally non-refundable;
- if a verified technical fault caused by our platform prevents completion or delivery, we may restore access, issue a replacement token, regenerate the profile, or provide another appropriate remedy;
- organizational packages may be governed by separate commercial terms.
Any mandatory consumer rights that apply in your country remain unaffected.
7. Assessment tokens and attempts
Assessment tokens are personal, confidential, and normally valid for one participant and one attempt.
You must not share, sell, transfer, publish, or misuse a token. A finalized attempt may not be reopened unless an authorized retake or replacement token is issued.
The platform may automatically finalize an attempt where the assessment reaches an applicable time or completion condition, where the participant submits the assessment, or where the product rules otherwise require finalization.
8. Assessment integrity
You agree to complete the assessment yourself and to respond without unauthorized assistance intended to misrepresent your answers or performance.
You must not:
- copy, photograph, record, scrape, extract, publish, sell, or redistribute assessment items or answer options;
- attempt to obtain scoring keys, forced-choice weights, validity rules, answer keys, or proprietary methodology;
- reverse engineer, automate, script, interfere with, or bypass the assessment or its security controls;
- use another person's token or allow another person to complete your assessment;
- use IWPA content or outputs unlawfully or to facilitate unlawful discrimination;
- access another participant's profile without authorization.
We may suspend access, invalidate a token, withhold a profile, or take other proportionate action where we reasonably believe assessment integrity or platform security has been compromised.
9. Intellectual property
IWPA and its assessment methodology, item framework, psychometric structure, questions, scoring materials, validity rules, profile content, brand elements, and related intellectual property are jointly owned by The Fourth Dimension Training & Consultancy FZ LLC and PCI Learning & Development, or used under applicable licence.
The platform software and technology delivered through Phoenix by 4D are owned by The Fourth Dimension Training & Consultancy FZ LLC or its licensors.
You receive a limited, personal, revocable, non-exclusive, and non-transferable right to use the service and your own profile for lawful personal or professional purposes. No ownership rights are transferred to you.
You may share your own profile at your discretion. You may not commercially reproduce profile templates, remove ownership notices, imply endorsement, expose assessment items, or use IWPA materials to create a competing or derivative assessment.
10. Organizational use
An organization may invite candidates, employees, learners, members, or other participants to complete IWPA for a disclosed purpose.
The organization must:
- clearly state why the assessment is being requested;
- tell participants what results or profile the organization will receive;
- use results only for the disclosed and lawful purpose;
- restrict access to authorized personnel with a legitimate need;
- comply with applicable employment, equality, privacy, and data-protection requirements;
- avoid using IWPA as the sole basis for a consequential decision;
- provide any additional local notices or consent required in its jurisdiction.
An organization is responsible for its own decisions and for how it uses the information it receives.
11. Profile access and confidentiality
Profiles may be delivered through a secure web link, account history, email notification, or downloadable file.
You are responsible for protecting access to your email, profile link, downloaded files, and devices.
A participant may choose to share their profile. We are not responsible for disclosures made voluntarily by the participant after delivery.
Where an organization receives an approved organizational output, its access is limited to the product, campaign permissions, contract, consent, and applicable law.
12. Research, averages, validation, and benchmarking
With the participant's applicable consent, we may retain and use de-identified or pseudonymised assessment data to validate IWPA, improve scoring and interpretation quality, monitor fairness, calculate aggregate statistics and averages, and develop future benchmark datasets.
Names, email addresses, phone numbers, token secrets, and other direct contact details are not included in research or benchmark datasets used to calculate averages.
Research and benchmark records may use a random or pseudonymous identifier. Where a reversible link is retained for governance, deletion, audit, or consent management, access to that link is restricted. Pseudonymised information is not described as anonymous.
Population comparisons are shown only where an approved benchmark dataset satisfies the governance and minimum-sample requirements stated in the Benchmarking and Data Use Policy. Otherwise, profiles use the participant's own internal pattern and do not claim a population percentile.
13. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.
Maintenance, connectivity failures, third-party service interruptions, security events, or circumstances outside our reasonable control may delay an assessment or profile.
If profile generation fails, deterministic scores are not changed or fabricated. We may retry generation, restore delivery, or provide another appropriate remedy.
14. External providers
We use external service providers for functions such as hosting, database services, secure file storage, transactional email, payment processing, security, and AI-supported narrative generation.
These providers process information only as needed to provide their services to us and are subject to their own contractual and legal obligations.
15. Acceptable use
You must not use the site or service to:
- violate law or another person's rights;
- introduce malicious software;
- attempt unauthorized access;
- overload, disrupt, or damage the service;
- impersonate another person or organization;
- conduct unauthorized surveillance or profiling;
- create or distribute misleading claims about what IWPA measures.
16. Suspension and termination
We may suspend or terminate access where reasonably necessary to address unlawful use, fraud, security risk, non-payment, breach of these Terms, or compromise of assessment integrity.
Provisions concerning intellectual property, confidentiality, data use, liability, and disputes continue to apply where relevant after termination.
17. Disclaimers
To the extent permitted by law, the service and profiles are provided on an as-available basis. We do not guarantee that every interpretation will apply in every context or that any recommendation will produce a particular outcome.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
18. Limitation of liability
To the fullest extent permitted by applicable law, The Fourth Dimension Training & Consultancy FZ LLC, PCI Learning & Development, Phoenix by 4D, and their respective officers, employees, contractors, and licensors are not liable for indirect, incidental, special, punitive, or consequential loss arising from use of the service or reliance on a profile.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where such limitation is unlawful, or any other liability that cannot legally be limited.
For paid consumer purchases, our aggregate liability relating to the relevant purchase will not exceed the amount paid for that purchase, except where applicable law requires otherwise.
19. Governing law and international users
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai.
The courts of Dubai have jurisdiction over disputes, unless mandatory law gives you the right to bring a claim elsewhere.
If services are provided by a local affiliated entity, an order form or regional supplement may specify different governing terms.
Nothing in this section removes mandatory consumer or privacy rights that apply in your country or state.
20. Changes to these Terms
We may update these Terms as the service evolves. The published version will show its effective date and version.
Where a change materially affects an existing purchase, account, or ongoing processing activity, we will provide reasonable notice where required.
